General

• Members must be 18 years of age or older.

• The Dining Plus Loyalty program is intended for individual use only. Spouses may not share a membership; in order to accrue points Spouses must have their own membership. Only one card will be issued per person.

• Points may not be accumulated for a business entity. Points can only be earned at the time of purchase.

• Carmelo’s Ristorante reserves the right to audit any account at any time. Accounts will be audited at our discretion and inactivated if fraud is suspected.

• Carmelo’s Ristorante may cancel the program at any time; in such an event any rewards earned prior to the member receiving the notice shall be redeemable for a period of 30 days after issuance of notice of discontinuation of the program.

• Member benefits, including promotional offers, Dining Plus rewards, birthday and anniversary certificates, may cease after four months of no account activity.

• Carmelo’s is not liable for points or rewards lost due to fraudulent or unauthorized use. This includes fraud caused by lost cards. Carmelo’s cannot replace reward certificates if they are lost or stolen.

• In the event of a lost or stolen card, upon notification, Carmelo’s Ristorante will transfer the outstanding balance of any unused points and rewards to the replacement card and the prior card will be inactivated. However, Carmelo’s Ristorante is not responsible for lost points or rewards associated with the lost or stolen membership cards. Carmelo’s reserves the right to charge $5 for replacement of membership cards.

• For membership purchased online, members will receive their Dining Plus card in the mail with the $25 certificate within 5 business days. If a member wishes to earn points prior to waiting for the card, members may present their telephone number 24 hours after joining the program.

• The changing nature of the restaurant industry requires that Carmelo’s Ristorante adapt and modify its program rules from time to time; some changes may adversely affect the value of points or rewards already accumulated and the right to certain rewards. We will notify members of any such changes on our website. You should occasionally check the rules on the website, as they are and will be the authoritative statement of the rules in effect at any time. Your continued participation in the program constitutes consent to any such changes.

• Carmelo’s Ristorante employees and family members (defined as spouses, children, parents, or grandparents) or people living in the same household as a Carmelo’s employee are not eligible to participate.

Points

• Points are accumulated at the rate of one point for $1.00 spent on food and beverages, excluding tax and gratuity.

• Points are credited to your account when presenting your Dining Plus Loyalty card to your server at the restaurant. In lieu of the membership card members may provide the phone number identified in their account registration to earn points at the time of purchase.

• Only the member paying the bill may accumulate points. If a bill is paid by credit card, the name on the card must match the name on the Dining Plus Loyalty card.

• Members cannot obtain points for purchases made prior to enrollment.

• Accumulated points are not member property and may be revoked, cancelled, limited, or modified at any time, even though such action may affect the member’s right to use previously accumulated points.

• Points have no cash value and may not be redeemed for cash.

• Points are non-transferable and non-divisible, and may not be combined with other members’ accounts.

• Unused points expire 4 months from the date of your last transaction.

• Points are not permitted to be added to a member’s account for visits prior to enrollment.

Rewards

• Rewards are redeemable at either location. To redeem the Chef’s Dinner for Two please give 24 hours notice with your reservation.

• Reward certificates may not be used with other promotions, offers, discounts, or prix fixe meals.

• Loyalty Program benefits and rewards are available at our Austin and Houston locations.

• Reward certificates are not valid for tax or gratuity. Federal and state tax liabilities are the responsibility of the cardholder.

• Rewards may not be used to purchase gift cards or certificates.
